These Terms are applicable to your use of any products or services provided by FamSAFE360, as outlined in these Terms. This includes all software integrated into our Service, whether accessed through the website at https://www.famsafe360.com/ or a mobile application, or by any other means.
These Terms apply when you:
(i) Create an account in connection with the Services
(ii) Download or use any Software in connection with the Services; and
(iii) Use the Services or engage with FamSAFE360 in connection with the Services in any other way

Pricing
At FamSAFE360, we offer straightforward plans designed to provide you with the best features for safeguarding your loved ones. With our user-friendly interface, simply choose the plan that aligns with your needs, and you'll gain immediate access to services. There are no complex renewal processes – once you've selected your plan, you can enjoy uninterrupted protection. We believe in simplicity and transparency, ensuring that your focus remains on what matters most – the safety and well-being of your family. FamSAFE360 is committed to delivering reliable services without the hassle, making it easy for you to stay connected and secure.
Payment Procedures
A valid payment method is necessary to process your subscription payment. You are responsible for providing accurate and complete billing information, including your full name, address, state/province/territory, zip/postal code, and valid payment method details to FamSAFE360. By submitting this payment information, you automatically authorize us to charge all service fees incurred through your account to the designated payment instruments.
Unless explicitly stated otherwise, all payments made are non-refundable. Additionally, you agree to bear any applicable state/provincial/territorial, federal, or other taxes associated with the Services, including sales taxes. This responsibility extends to covering transaction fees and currency conversions imposed by your financial institution and intermediaries. All amounts are presented in U.S. Dollars.
For payments made via a credit or debit card ("Payment Card"), you:
(a) assert that you are authorized to use the Payment Card
(b) commit to maintaining the validity and currency of your Payment Card details; and
(c) agree to cover any processing fees imposed by third-party payment processors or the Payment Card issuer.
Should your Payment Card be declined during a charge attempt, we may make additional attempts at a later time. Failure to receive payment may lead to the suspension or termination of your plan.
Changes in Fees
We reserve the right to adjust the fees for FamSAFE360 services at our discretion. However, we commit to providing you with at least thirty (30) days' notice before implementing any such changes. Unless otherwise specified in our notice to you, alterations to fees will become effective immediately following the notice period.
Refund Policy:
Our commitment at FamSAFE360 is to provide valuable services to enhance your digital security. Once a service has been provided, we are generally unable to issue a refund. However, if you have paid for a service that you haven't utilized, we understand that circumstances may arise, and you may request a refund.
a. Missed Appointments (Two Occurrences): If you happen to miss two scheduled appointments, we encourage you to contact us within two weeks to reschedule. We understand that unexpected events can occur, and we are here to accommodate your needs.
b. Missed Appointments (Three Occurrences): In the event of missing three scheduled appointments, we will refund 70% of the purchased price. We value your commitment and understand that situations may arise. Please note that after three missed appointments, the client will need to purchase a new plan if interested in availing any services by FamSAFE360.
At FamSAFE360, we strive to find fair solutions that consider both your needs and our commitment to providing quality services. Our refund policy is designed to address specific situations and ensure a transparent and customer-centric approach to any potential refund requests.
General Legal Terms
IMPORTANT NOTICE REGARDING ARBITRATION FOR U.S. CUSTOMERS – IF YOU RESIDE IN THE U.S. WHEN YOU ACCEPT THESE TERMS, YOU AGREE TO RESOLVE ALL DISPUTES WITH FAMSAFE360 AND ITS AFFILIATES THROUGH ARBITRATION ON AN INDIVIDUAL BASIS RATHER THAN JURY TRIALS OR CLASS ACTIONS.
Eligibility
Our Services are not accessible to individuals who are not Eligible or to any users previously suspended, terminated, or removed from the Services by FamSAFE360. “Eligible” means that you reside in the United States of America and (i) you are 18 years of age or above the age of majority in your jurisdiction of residence (whichever is greater); or (ii) under the age of majority in your jurisdiction of residence and are using the Services with the permission and involvement of your parent or legal guardian who has agreed to these Terms. By downloading, using, or accessing the Services, you represent and warrant that you are Eligible. If you are a parent or legal guardian of either (1) a user under the age of majority or (2) a senior or elderly user (“Senior Member”) with limited use allowed under the Services, by allowing the child member (a child under the legal age of majority in their jurisdiction of residence) and/or Senior Members (together, “Junior Members”) to use the Services on the Family Plan or you are acknowledging that you are subject to these Terms and responsible for the Junior Members’ activity on the Services. Under no circumstances may anyone under 13 years of age use or access the Services at any time or in any manner or submit any information through the Services outside of the circumstances outlined in this section.
If you fail to provide the required personal information necessary for the selected plan during the enrollment process, FamSAFE360 may be unable to deliver the specified services. You acknowledge that you are responsible for ensuring the provision of necessary information for the chosen plan. FamSAFE360 cannot be held liable for any inability to provide the required service due to the lack of information provided by you.

At FamSAFE360, our commitment goes beyond providing a one-time solution; we are devoted to staying ahead of these challenges, consistently improving our services, and ensuring you receive the best possible protection against emerging threats.We recognize the dynamic nature of the digital landscape, where new risks may surface over time. While our services are designed to effectively mitigate these risks, it is essential to note that we cannot assure absolute prevention or offer future-proof solutions. User Data, Accounts, and Passwords
You are fully and solely responsible and liable for the content and data you enter into our Services. Registration as a user with the Services may require both a username and a password.. You should consider your usernames and passwords as confidential information. Anyone with knowledge of both your username and password can gain access to the restricted portions of the Services and your account. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password, whether your password is with our Services. You agree not to disclose your password to any third-party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We are not responsible for your failure to do so, or for any delay in suspending or terminating your account after you do. You are responsible for all use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene. We reserve the right to block a user’s account and/or prohibit a user from using the Services in the event of any suspected or actual fraud or a violation of these Terms, as determined in our sole discretion.We do not store or sell users' data. We are not linked with third-party advertising to share your data. Your privacy and data security are our top priorities.
User Submissions; Feedback
If you provide to FamSAFE360, either directly or through a third-party such as the Apple App Store, feedback and/or reviews, suggestions, comments, or ideas relating to the Services (“Submissions”), you grant, to the maximum extent permitted by applicable law, FamSAFE360 a royalty-free, perpetual, irrevocable, worldwide, unlimited, nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the Submission in any media or medium, or any form, format, or forum, now known or hereafter developed, to improve or market the Services or for any other reasonable business purpose. No compensation will be paid with respect to the use of your Submission. FamSAFE360 is under no obligation to post or use any Submission you may provide, and FamSAFE360 may remove any Submission at any time in its sole discretion and without notice. By providing a Submission to FamSAFE360, you represent and warrant that you own or otherwise control all of the rights to your Submission that are necessary for you to provide it, including Intellectual Property Rights. You agree that: (i) all content of your Submissions must be accurate; (ii) you will not provide a Submission that is known by you to be false, inaccurate, or misleading and/or may be reasonably considered to be defamatory, hateful, offensive, unlawfully threatening or unlawfully harassing to anyone; (iii) you will not provide a Submission that infringes or violates FamSAFE360 Intellectual Property Rights or other proprietary rights or rights of privacy; (iv) you will not provide a Submission that violates any applicable law, statute, ordinance, or regulation; (v) you shall not provide any Submission that includes information that references other websites, addresses, email addresses, contact information, phone numbers, or other personally identifiable information for anyone; and (vi) you will not provide a Submission that contains any potentially damaging computer programs or files.
You are responsible for your Submissions. Your Submissions shall not be deemed confidential, and FamSAFE360 shall not have any obligation to keep any such material confidential.
Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold FamSAFE360, its affiliates, agents, suppliers,, and licensors (collectively referred to as the "FamSAFE360 Entities"), and each of their respective contractors, subcontractors, officers, directors, shareholders, employees, and agents, harmless from any claims, losses, damages, liabilities, including legal fees and expenses, arising from your use and misuse of the Services, any violation of these Terms by you, or any breach of the representations, warranties, and covenants made by you herein. FamSAFE360 reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are obligated to indemnify the FamSAFE360 Entities, and you agree to cooperate with FamSAFE360 in defending against such claims. FamSAFE360 will make reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
Disclaimers; No Warranties
To the maximum extent allowed by law, excluding the rights granted to individuals under applicable laws, and unless expressly prohibited by law for individuals residing in the province of Quebec, FamSAFE360 disclaims all warranties, whether statutory, express, or implied, encompassing but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. Any information, whether communicated orally or in writing, obtained from FamSAFE360 or through the Services does not create any warranty not explicitly stated herein. You explicitly acknowledge that the use of the Services is solely at your own risk. The Services, along with any data, information, third-party software, services, or applications made accessible through or in connection with the Services, are provided on an "as is," "as available," and "with all faults" basis, with no assurance that the Services will withstand attempts to evade security mechanisms or that there will be no cracks, bugs, disablements, or other circumvention. FamSAFE360 does not guarantee that the Services will be uninterrupted or free from errors, viruses, or other harmful components, and it does not guarantee the correction of any such issues. Your use, access, or download of the Services, or any transmission of materials, data, or other content while using the Services, is done at your own discretion and risk.
Limitation of Liability and Damages
To the fullest extent permitted by law, and except where expressly prohibited for individuals residing in the province of Quebec, FamSAFE360 and the FamSAFE360 Entities shall bear no obligation or liability (whether arising in contract, warranty, including negligence, product liability, or otherwise) for any damages or liabilities, including direct, incidental, indirect, special, or consequential damages (including any loss of data, revenue, or profit, or damages arising from personal injury/wrongful death) in connection with your use of the Services, even if the possibility of such damages has been advised. This limitation applies to damages arising from (i) the use of or inability to use the Services, (ii) the cost of procurement of substitute goods and services, (iii) unauthorized access to or alteration of your transmissions by third parties, (iv) or any other matter relating to the Services.
Additionally, when using the Services, information will be transmitted over a medium beyond the control and jurisdiction of FamSAFE360, mentioned on the Services. Consequently, FamSAFE360 assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with the use of the Services.
To the fullest extent permitted by law, FamSAFE360 shall not have any liability to you as an agent in obtaining copies of any of your credit report, credit alert report, quarterly update, or credit score. FamSAFE360 does not make any warranty, express or implied, for the accuracy of the information contained in or provided in conjunction with the FamSAFE360 services. None of these entities assume any liability for damages, whether direct or indirect, consequential or incidental, in connection with the performance of the services or your request, use, or attempted use of the services. Moreover, neither FamSAFE360 nor any of their respective affiliates or credit information subcontractors are responsible for negative factual information contained in any reports you receive as part of the service. The aggregate liability of all such parties to you, in any event, is limited to the amount you have paid FamSAFE360 for the services. FamSAFE360 products and services are not a credit counseling service and do not promise to help you obtain a loan or improve your credit record, history, or rating. The terms of this section shall survive any termination, cancellation, or expiration of this agreement.
Basis of the Agreement
You acknowledge and consent that FamSAFE360 has presented the Services, established its pricing, and entered into these Terms relying on the warranty disclaimers and limitations of liability stated herein. Recognizing that these warranty disclaimers and limitations of liability represent a fair and reasonable distribution of risk between you and FamSAFE360, you agree that they constitute a fundamental basis of the agreement between you and FamSAFE360. FamSAFE360 would be unable to offer the Services to you in an economically feasible manner without these limitations.
Dispute Resolution Through Binding Individual Arbitration

TO THE FULLEST EXTENT PERMITTED BY LAW AND EXCLUDING INDIVIDUALS RESIDING IN THE PROVINCE OF QUEBEC, if customer service cannot resolve a complaint you have with FamSAFE360 or its service provider(s) satisfactorily (or if attempts at informal resolution have failed), you, on one hand, and FamSAFE360 or its service provider(s), on the other, mutually agree to settle such disputes through the Arbitration Agreement outlined in this Section. This Arbitration Agreement mandates resolving all disputes (except those expressly exempted in this Section) through binding arbitration on an individual basis, rather than in general jurisdiction courts. Arbitration is a less formal process than a court lawsuit, utilizing a neutral arbitrator instead of a judge or jury, allowing more limited discovery than in court, and being subject to very restricted court review. Arbitrators have the authority to grant the same damages and relief as a court. All arbitrations under these Terms will be conducted on an individual basis; class arbitrations and class actions are not permitted.
Termination
FamSAFE360 reserves the right to terminate your access to the Services at any time and for any reason, including, but not limited to, any actual or suspected violation of these Terms or any unacceptable or objectionable use of the Services, as determined solely by FamSAFE360. You acknowledge and agree that such termination or discontinuation may occur without prior notice, and FamSAFE360 shall not be held liable to you or any third party for such actions.If you have been terminated from the Services and wish to request a refund, please reach out to us through the contact details provided in your account dashboard, which, as of the current information, includes the phone number +1 808-207-7233 and email support@famsafe360.com. Describe the circumstances surrounding the termination or discontinuation of your use of the Services. Any suspected fraudulent, abusive, or illegal activity may be reported to appropriate law enforcement authorities. These measures complement any other remedies FamSAFE360 may have under applicable law or equity.
Modification of this Agreement
FamSAFE360 retains the right to modify these Terms at any time, including reflecting changes in applicable law or introducing additional features or functionalities into the Services. Notification of such changes may occur through reasonable means, such as posting a revised version of these Terms within the Services. It is your responsibility to regularly check the Services for any updated Terms. By continuing to use or access any of the Services or engaging with FamSAFE360 after we post changes, you acknowledge acceptance of the updated Terms. The "Last Updated" legend above indicates the date when these Terms were last revised. In cases where a revision significantly impacts your rights, as determined by FamSAFE360 at its sole discretion, we will make reasonable efforts to notify you in advance of the change becoming effective. This may involve sending a notification to the email address(es) associated with your account or displaying a pop-up or banner within the Services. In any event, the most current version of these Terms will be posted within the Services. Changes will be effective no sooner than the last updated date. By continuing to use the Services after the date the changes become effective, you signify your agreement to be bound by the updated Terms. If you disagree with any changes made to these Terms, you must promptly cease using the Services.
